Taking Regulatory Action

The Apprenticeships, Skills, Children and Learning Act 2009, sets out clearly and fully Ofqual’s powers to take action to secure compliance with our regulatory requirements and to address shortcomings or failures by Awarding Organisations.

Our policy, Taking Regulatory Action, sets out the approach we will follow in exercising these powers and the matters to which we will have regard. It addresses the regulatory action we can take in response of awarding organisations and the regulated qualifications they award.

Taking Regulatory Action also explains how our approach to taking action will escalate, and be proportionate to the impact of the matters being addressed. Any action that we take will be on the basis of our regulatory requirements and will typically be to protect the interests of learners, securing public confidence and the standards of qualifications.
